Terms of Use

These Terms of Use (“Terms”) govern your access to and use of modeedu.com (the “Site”), the Mode Education learning platform and related services (together, the “Services”), operated by Mode Education (“Mode Education”, “we”, “us”, “our”). By accessing or using the Services you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be able to form a legally binding contract to use the Services. If you are under 18, or under the age of majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or guardian who agrees to these Terms on your behalf.

2. The Services

Mode Education provides IELTS Writing preparation, including learning content, an exam simulator, practice tasks and feedback. We may add, change or remove features at any time. Our content is provided for general educational purposes and does not constitute professional, immigration or academic advice.

3. Your account

  • You must provide accurate, current and complete information and keep it up to date.
  • You are responsible for safeguarding your login credentials and for all activity under your account.
  • Please notify us immediately of any unauthorised use of your account or any security concern.

4. Early access and the Founding Cohort

From time to time we offer a limited number of early-access or “Founding Cohort” places, which may include complimentary access to a course before public launch. These offers are limited in number, made at our discretion, and subject to availability and any conditions we specify. Submitting an application does not guarantee a place. We will contact applicants directly, and we may withdraw or change an offer at any time before it is accepted.

5. Pricing, payment and taxes

  • Prices are shown at the point of purchase, generally in US dollars (USD). Prices may change, but changes do not affect orders that are already complete.
  • Payments are processed by Square. By purchasing, you authorise us, through Square, to charge your chosen payment method.
  • You are responsible for any taxes, duties or charges that apply to your purchase, unless we state otherwise.

6. Course access and licence

When you purchase a course, we grant you a limited, personal, non-exclusive and non-transferable licence to access that course for the applicable access period (for example, 30, 60 or 90 days depending on the product) for your own learning. You may not share, resell, sublicense or otherwise provide access to anyone else.

7. Refunds and cancellation

Our courses provide immediate access to digital content. For that reason, purchases are generally non-refundable once access has been granted, except where a refund is required by law or where we agree otherwise. Nothing in these Terms excludes, restricts or modifies any consumer guarantee or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. If you believe you are entitled to a refund, contact us at hello@modeedu.com within 14 days of purchase and we will assess your request.

8. Acceptable use

You agree not to:

  • Copy, reproduce, distribute, scrape or create derivative works from our content, except as expressly permitted.
  • Share your account or course access with others.
  • Interfere with, or attempt to gain unauthorised access to, the Services, other accounts or our systems.
  • Upload unlawful, infringing, harmful or malicious content.
  • Use the Services to breach any law or any third party’s rights.

9. Intellectual property

All content, materials, software, designs, text, graphics and trademarks within the Services are owned by Mode Education or its licensors and are protected by intellectual property laws. Other than the limited licence granted in section 6, no rights are granted to you.

10. Your content

You retain ownership of the work and submissions you create, such as your writing tasks. You grant us a licence to use, store, reproduce and process your submissions solely to provide the Services to you, including marking, feedback and platform operation. You are responsible for ensuring your submissions do not infringe any third party’s rights.

11. No guarantee of results

We are committed to high-quality preparation, but we do not guarantee any particular IELTS band score or examination outcome. Results depend on many factors outside our control, including your own effort, starting level and performance on the day of the exam.

12. Third-party services

The Services rely on and link to third-party services, such as payment processing and video hosting. Your use of those services may be subject to their own terms, and we are not responsible for them.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available”, and we exclude all warranties not expressly set out in these Terms. We do not warrant that the Services will be uninterrupted, error-free or secure. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

14. Limitation of liability

To the maximum extent permitted by law, Mode Education is not liable for any indirect, incidental, special or consequential loss, or any loss of profits, data or goodwill. Where our liability cannot be excluded but can be limited, our total aggregate liability is limited to the amount you paid for the relevant course in the 12 months before the claim or, at our option, the re-supply of the services.

15. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, losses and costs arising from your breach of these Terms or your misuse of the Services.

16. Suspension and termination

We may suspend or terminate your access if you breach these Terms or to protect the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination - including intellectual property, disclaimers and limitation of liability - will survive.

17. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

18. Changes to these Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance. The “Last updated” date above shows when they last changed.

19. Governing law and disputes

These Terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of its courts. Before commencing any proceeding, you agree to contact us first so that we can try to resolve the matter.

20. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. These Terms are the entire agreement between you and us regarding the Services.
